Trackr Lab is a SaaS mode tool allowing centralised management of music production for music creators. These general conditions of sale and use (hereinafter “Terms of service”) are intended to define the terms and conditions of use of the services and extensions offered by the trackrlab.com site (hereinafter “the Site / The Platform ”), which is published by the company TRACKR LAB, SAS with a registered capital of 1000€, located 96 Rue Paradis, 13006 Marseille - France, + 33 63 14 86 07.

The Site / Platform allows the use of access to the services described in Article 1. of these terms of services and privacy policy. Access to the Services can only be done through the Internet network and requires a prior connection to the said network at the following Internet address: https://app.trackrlab.com
By browsing the Site / Platform, the User accepts all of these terms of services. These terms of services and privacy policy may be modified or supplemented at any time, Users of the Site / Platform are therefore invited to consult them on a regular basis.
When registering online, the User undertakes to provide true, exact and complete information as requested in the registration form and therefore to keep it up to date without delay. In the event that the User provides false, inaccurate, outdated or incomplete information, the Site is entitled to suspend or terminate his Subscription and to refuse him, immediately and for the future, access to all or part of the Site / Platform.
Minors are allowed to register and / or subscribe to the Site / Platform, on condition that they have previously obtained the authorization to do so from their holder (s) of parental authority, and that their parental authority holder (s) has (have) agreed to be the guarantor (s) of the minor user’s compliance with these terms of services and privacy policy. Any use of the services and / or subscriptions available on the Site / Platform by a minor User is carried out under the full responsibility of the holder (s) of parental authority over the minor user concerned.
If the User benefits from the Service on behalf of his employer and / or another organization, the User accepts all of these terms of services and privacy policy and declares that he can do so.
In case of non-acceptance of these terms of services and privacy policy, the User must renounce access to the Services offered by the Site / Platform.
Trackr Lab offers a free trial of its service for 30 days, giving users access to all functionalities. The free trial requires an online registration by the User giving him access to the services.
The use of the Trackr Lab Services is invoiced in return in the form of an Semestrial or Monthly Subscription, the price of which is indicated on our pricing page and/or sent by e-mail by quote. The Subscription will take effect from the date of electronic validation hereof. It is concluded for an indefinite period with or without a minimum initial period of commitment, depending on the Subscription formula that the User has chosen. To be able to benefit from the Services, except for the free trial, the User will pay a periodic fee in accordance with the specific conditions specified by the terms of services.
Access to the Services and the use of the related extensions is a right granted exclusively under the conditions determined by the Subscription taken out, in particular for the number of Users, the functionalities, the assistance and the storage space defined by the formula subscribed.
When the User places an Order, he expressly acknowledges having read these terms of services and privacy policy, prior to placing the Order. The validation by the User of the Order constitutes acceptance of the terms of services and privacy policy, a copy of which can be viewed on the dedicated tab and / or downloaded online from the Site / Platform. A summary of the Online Order will be sent to the e-mail provided when registering to the User. Any order implies an obligation to pay for the Order by the User. The User acknowledges that the placing of an Order commits him to payment for it.
The total price of each Subscription is paid at the start of the Subscription or of the renewed period, unless otherwise indicated on the order form. Payment is made by direct debit from the bank details provided on registration. The direct debit is implemented by one of our secure payment providers, who alone keeps your payment details: Trackr Lab does not keep any bank details. The User guarantees that he has the necessary funds and authorizations to use the chosen payment method. The User agrees to take the necessary measures so that the automatic debit of the price of the Services can be made.
For any delay or incident of payment of all or part of an amount due automatically results, without prior notice:
The user is solely responsible for the use he makes of the Site/Platform. He expressly acknowledges that his use of the Site/Platform and the Services is at his own risk and that the Site/Platform is accessible to him “as is” and depending on its availability.
The user undertakes to behave in a normal and reasonable manner and not to hinder, in any way whatsoever, the proper functioning of the Site/the Platform. The user undertakes to use the Services and all the information to which he/she may have access only for personal reasons and for a purpose that is consistent with public order, good morals and the rights of third parties.
The user undertakes not to disrupt the use that other users may make of the Site/Platform, not to access the accounts of third party users, not to fraudulently access, hinder or disrupt the access systems of the Site/Platform and not to bypass, disable or disrupt the security systems of the Site/Platform.
In the event of a breach by the User of one or more of its obligations under these terms of services and privacy policy, Trackr Lab reserves the right to disable the user’s access to the Site/Platform and the Services temporarily or permanently, without prejudice to any damages.
The Subscription can be terminated at any time, by email notification to the following address: ops@trackrlab.com
Trackr Lab will take care of the termination and deactivation of the automatic renewal as soon as possible. This action can be canceled within 15 days of the deactivation of the account by our services, by express request of the creator of the workspace in question by email to the aforementioned address. After this period, this action is irreversible and therefore does not allow the account data to be recovered subsequently.
The termination does not entail any penalty and does not give rise to reimbursement for the current period.

Trackr Lab is bound by an obligation of means concerning the accessibility, the functioning and/or the availability of the Site/Platform and/or the Services. Trackr Lab reserves the right to interrupt, suspend or limit access to all or part of the Site/Platform and/or the Services, in particular due to technical or legal constraints.
Trackr Lab cannot be held responsible for any direct or indirect damage caused to the user’s equipment when accessing the Site, and resulting either from the use of equipment that does not meet the specifications indicated in this article, or the appearance of a bug or an incompatibility.
Trackr Lab cannot be held liable for indirect damages (such as, for example, a loss of market or loss of opportunity) resulting from the use of the Site. The user has the right to ask any question relating to this Site, as well as his personal data to the email address and the telephone number provided in these terms of services and privacy policy.
Trackr Lab reserves the right to remove, without prior notice, any content posted in this space that would violate the law applicable in France, in particular the provisions relating to data protection. Where applicable, Trackr Lab also reserves the right to question the civil and / or criminal liability of the user, in particular in the event of communication of a racist, abusive, defamatory or pornographic message, whatever the medium. used (text, photography…).
Trackr Lab cannot be held responsible for material damage related to the use of the Site / Platform.
The User makes sure to keep his password secret. Any disclosure of the password, whatever its form, is prohibited. He assumes the risks associated with the use of his username and password. The Site / Platform declines all responsibility in this regard.
The Site / Platform cannot be held liable in the event of force majeure or the unforeseeable and insurmountable fact of a third party.
In order to constantly improve the quality of its Services, its form and nature, in particular the mode of access to existing functionalities, are subject to change without notice, for technical and / or editorial reasons, the User accepts that this maintenance may give rise to a temporary suspension of the Service and of access to the Service. This suspension will take place as far as possible between 10 p.m. and 7 a.m. on working days. The User will be notified 24 hours in advance, by email or via the Service. The user also has access to an internet support web space providing user guides, FAQs and videos. The User, as part of the access to the subscribed Service, benefits from a guarantee of backup of his data.
If the User accepts to be informed by e-mail of new services, product launches, changes to the conditions of use or invoicing of the Services, the User will receive these notifications at the e-mail address provided within the Personal Space.
Any dispute in connection with the use of the Trackr Lab site will be the subject of an attempt to resolve it amicably. Otherwise, disputes will be subject to French law and brought to the competent courts of Paris.
If any of the provisions of these Terms of services and privacy policy were declared null or inapplicable in application of a law, a regulation or following a court decision that has become final, it would be deemed unwritten and the other provisions would remain in force.
